“In particular, he accepted the detailed description provided by the officer in the circumstance where the officer was a short distance from the inside of the vehicle in terms of observing the location of the phone. It will, in any event, become clear that it would not have made any difference at the end of the day, even if Mr. Mirza’s evidence was accepted — that his phone was leaning on his body or touching his leg, rather than being ‘on his leg.’”
As an aside but driving related, I testified in court that a subject was observed passing two vehicles on a double line. The driver got on the stand and said, "He is a lying son-of-a-bitch, I passed four cars not two."
