The male actor who made the comment wasn't fired but the recipient of his caustic, sexist remarks was.
CBS confirmed the allegations by Eliza Dushka and settled a lawsuit for over nine million dollars.

"In front of the cast and crew, Mr. Weatherly remarked on her appearance, and made a rape joke and a comment about a threesome. Shortly after Ms. Dushku confronted the star about his behavior, she was written off the show.
"CBS, agreed to pay her $9.5 million, roughly the equivalent of what Ms. Dushku would have earned if she had stayed on as a cast member for four seasons."
Might the above be the reason Weatherly wasn't fired?
Steven Spielberg had been one of the show's executive producer until this incident and as the result of Weatherby's behavior, severed ties with the CBS show.
